National classification of criminal offense

Structure:

The classification of criminal offenses includes every criminal offense provided for in the Criminal Code of Montenegro and is applied in statistical surveys on adult and juvenile offenders.
For the coding of criminal offense in statistical forms are provided six-digit ciphers.
Coding layout was carried out as follows:
· First three code digits represent an article of the criminal offence of applied law. 
· Fourth coding place indicates: letter to the article, including: "a" as 1, "b" as 2, "v" as 3. Relation of basic criminal offense with serious criminal offense is labeled with code 4. In the column “article, paragraph, item and link of the articles and paragraphs” classification, in addition to the article basic of the criminal offense, an article of a serious criminal offense is provided with which the basic criminal offense is related.
· Fifth coding place indicates the paragraph to the article of a criminal offense. If the criminal offense does not have paragraphs but only article, the label code is 0.
· Sixth coding place represent: a) the relationship between paragraphs within the same criminal offense, that same article, b) the paragraph of a article of serious criminal offenses for which on the fourth coding place is used code 4; c), items 1,2,3,4,5 and 6 for criminal offenses - aggravated theft, abuse of authority in the economy, causing false bankruptcy, etc.
· Code 999999 indicates the criminal offenses foreseen by special laws outside the Criminal law.

Detailed description: Basic and higher prosecutor's offices and basic and higher courts, as the reporting units in statistical surveys on perpetrators of criminal offenses, are obliged to enter in prescribed statistical forms, among other things, answers to the following questions: legal title of criminal offense, the article, paragraph, item and links with other criminal offense under article, paragraph and item, as well as the name of the applied law. When the answer to the stated questions determines the criminal offense and the applied law, the criminal offense is coded with the code provided in the classification of criminal offenses.
