6.1. Legal acts and other agreements: | The Law on Official Statistics and Official Statistical System ("Official Gazette of Montenegro" No 18/12 and 47/19) defines provisions for collection, processing, and dissemination of data. The Law provides to the Statistical Office legal powers to collect and access the data necessary for the implementation of Programme and Annual Plan. The Law gives a priority to the use of administrative data and right of access to individual data that are a result of survey of other official statistical producers. As an annex to legal provisions, Statistical Office has signed several memoranda on cooperation with administrative data providers. |

7. Confidentiality Top |
7.1. Confidentiality - policy: | Articles 53-60 of the Law on Official Statistics and the Official Statistics System ("Official Gazette of Montenegro"No. 18/12 and 47/19) provide a framework for the protection, use and transfer of confidential data. MONSTAT has developed two comprehensive Regulations covering procedures for the protection of personal data, as well as the keeping of individual records. In order to implement the legal framework on the functioning of the security system and statistical confidentiality, the Rules on the Preservation of Statistical Data have been adopted which regulates the manner, time, technical conditions and organization of the preservation of statistical data in order to prevent their destruction, and unauthorized use, as well as the Rulebook on the Content and Manner of Keeping Records of Users of Individual Statistical Data, which prescribes the content and manner of keeping records of users of individual statistical data.
Article 59 access to confidential data of official statistics is restricted to persons performing tasks and tasks
with the producers of official statistics and to the extent that these data are necessary for the production of the official
statistics. Persons performing duties and tasks with producers of official statistics are obliged to sign a Statement of Compliance with the principle of confidentiality.
The Law on Official Statistics and the Official Statistics System is in accordance with Regulation 223/2009 and Regulation (EU) 2015/759 of 29 April 2015, which also regulates confidentiality provisions.
The Government of Montenegro has adopted a Statement on Commitment of Confidence Commitment to Confidence in Official Statistics of Montenegro. |

Release calendar: | The Law on Official Statistics and the Official Statistics System ("Official Gazette of Montenegro" No. 18/12 and 47/19) prescribes that producers of official statistics prepare, update and publish the calendar of publishing statistical data. It is published on the website of the Statistical Office no later than December 20 for the following year, for all producers of official statistics that include the dates of publication of statistical data. Any changes on the date of publication in the Calendar are published in advance in accordance with the Unmanaged Audit Procedure. |

Micro-data access: | The Law on Official Statistics and the Official Statistics System ("Official Gazette of Montenegro"No. 18/12 and 47/19) regulates the rules under which external users can gain access to individual data for research purposes. Article 58 defines the types of scientific and research organizations who can get such data.
Giving individual data without an identifier is possible only on the written request of scientific research institutions, for the purpose of carrying out scientific research activities, as well as international statistical organizations and producers of statistics from other countries.
The investigating entity signs the Agreement with the Statistical Office, as well as the Statement of Compliance with the principle of confidentiality.
Manufacturers of official statistics keep separate records of users and the purpose for which statistics are given for use. " |
